to Agisitges as far in advance as possible by email or phone.
Depending on when the cancellation or modification is communicated, and on expenses already incurred (e.g., venue reservations, third-party services, etc.),
Agisitges may:
- Retain the advance payment as compensation for administrative costs.
- Charge specific expenses arising from third-party services already contracted and non-refundable.
Specific cancellation conditions (deadlines, percentages, etc.) may be detailed in the quote or in the particular agreement with each client.
6.2. Modifications and Cancellations by Agisitges
Agisitges reserves the right to modify or cancel a route or activity in cases of force majeure or unforeseen circumstances that make its realization impossible
or very difficult (e.g., extreme weather conditions, public health incidents, venue closures, etc.).
In such cases, Agisitges will offer, where possible:
- An alternative date or time, or
- A proposal for an equivalent activity, or
- The reimbursement of amounts paid for services not rendered, if a satisfactory alternative is not possible.
7. Specific Conditions for Schools and Minors
For routes and activities that include minor students (over and under 14 years old), the following conditions will apply:
- Students must always be accompanied by teachers, monitors, or responsible persons designated by the educational center or organizing entity.
- The educational center or organizing entity is responsible for the supervision, conduct, and compliance with rules by minors throughout the activity.
- Agisitges commits to adapting, as far as possible, the content and pace of the activity to the ages and needs of the group, according to the information previously provided by the center.
- Any special needs (reduced mobility, allergies, etc.) must be communicated in advance to assess feasibility and, if applicable, implement the relevant adaptations.
8. Liability
Agisitges carries out its activities with professionalism and diligence, but cannot guarantee factors beyond its control
(weather conditions, incidents on public roads, changes in visiting hours of venues, etc.).
Agisitges will not be responsible for:
- Delays, changes, or cancellations arising from force majeure or unavoidable and extraordinary circumstances.
- Damages or losses caused by non-observance of the guide’s or Agisitges’ staff instructions.
- Damages or incidents arising from the negligent or imprudent conduct of participants.
In the case of activities with minors, the primary responsibility for supervision lies with the educational center or organizing entity and its accompanying staff.
9. Insurance
If applicable, Agisitges may have the relevant insurance policies according to the regulations applicable to the activity (e.g., civil liability insurance).
In any case, participants and contracting entities are recommended to have the insurance policies they deem appropriate (e.g., school insurance, travel insurance, etc.), in accordance with the nature of the activity.
10. Data Protection
The processing of personal data that may arise from the contracting and provision of Agisitges’ services is governed by the
Privacy Policy, which provides information on the data controller, purposes, legal basis, retention periods, recipients, and rights of data subjects.

11.3. Consumer Bodies and Dispute Resolution
Without prejudice to the right to appeal to the courts, consumers may address competent consumer bodies to file complaints or request consumer mediation or arbitration, in accordance with current regulations.
This may include, among others:
- Municipal Consumer Information Offices (OMIC), if available in the corresponding municipality.
- Public consumer services of the Generalitat de Catalunya.
In the case of online contracting with consumers from the European Union, the European Commission’s online dispute resolution (ODR) platform may also apply, where appropriate, accessible through official EU channels.
12. Applicable Law and Jurisdiction
These General Terms and Conditions of Contract are governed by Spanish law and, where applicable, by the relevant Catalan regulations.
In case of conflict or discrepancy in the interpretation or application of these conditions, the courts and tribunals determined by the applicable consumer and user regulations will be competent.
When consumer regulations are not applicable, the parties expressly submit to the courts and tribunals of the city of Barcelona, waiving any other jurisdiction that might correspond to them.
13. Modification of Conditions
Agisitges reserves the right to update or modify these General Terms and Conditions of Contract to adapt them to legislative changes, jurisprudential criteria, or changes in the provision of its services.
The applicable conditions will be those in force at the time of formalizing the booking or contracting of the service, without prejudice to subsequent modifications that may be published for future contracts.
